Terms of Use
Chess40 · Version 0.9 (draft for legal review) · Last updated: 20 October 2026
These Terms of Use ("Terms") govern your use of Chess40 on Android, iOS and chess40.com (the "Service"), provided by Tibrcode Software Development, Abu Dhabi, United Arab Emirates ("Tibrcode", "we", "us"). By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
1. The Service
Chess40 is a chess game with play against the computer, play on one device, puzzles, lessons and, optionally, online games with friends. The Service is free and supported by advertising.
2. Your licence to use Chess40
We grant you a personal, non-exclusive, non-transferable and revocable licence to use the Service for your own non-commercial entertainment and learning, in line with these Terms and the rules of the store you downloaded it from. You must not copy, modify, distribute, sell, reverse-engineer or create derivative works from the Service, except where the law expressly allows it or where an open-source licence applies to a specific component.
3. Accounts
You can play without an account. To invite friends to online games you may create an account with Sign in with Apple or Sign in with Google. You must be at least 13 years old, or the minimum age of digital consent in your country, to create an account. You are responsible for activity under your account. You can delete your account at any time in Settings → Account → Delete account.
4. Online play and conduct
When you play online, you agree not to:
- use chess engines, other people or any outside help during an online game;
- choose a nickname that is offensive, hateful or sexual, that impersonates someone, or that infringes anyone's rights;
- harass, threaten or abuse other players, or misuse the report feature;
- interfere with the Service, exploit bugs, or access it by automated means.
You can report or block any player. We may remove nicknames, end games, and suspend or close accounts that break these rules.
5. Advertising
The Service shows advertising from third parties such as Google. We do not control or endorse advertisers' products or websites, and any dealings with advertisers are between you and them. Your choices about ad personalisation are described in our Privacy Policy.
6. Intellectual property
The Service, including its design, 3D world, artwork, logo, lessons and text, belongs to Tibrcode or its licensors and is protected by law. "Chess40" and the Chess40 logo are trademarks of Tibrcode. Some components are open-source software provided under their own licences, for example the Stockfish chess engine under the GNU General Public License v3. They are listed in Open-source licences, and nothing in these Terms limits your rights under those licences.
7. Updates and availability
We may update, change or discontinue features. Some updates may be required to keep using the Service, and the app will tell you when an update is available or required. We aim to keep the Service available, but we do not guarantee uninterrupted access, especially to online features.
8. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. Nothing in these Terms excludes any warranty or right that cannot be excluded under the law that applies to you.
9. Limitation of liability
To the fullest extent permitted by law, Tibrcode is not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to USD 50. These limits do not apply where the law does not allow them, including liability for death or personal injury caused by negligence, or for fraud.
10. Consumers
If you are a consumer, you keep all the rights you have under the mandatory consumer laws of your country of residence. These Terms do not affect those rights.
11. Ending your use of the Service
You may stop using the Service at any time. We may suspend or end your access if you seriously or repeatedly break these Terms, or if the law requires it.
12. Governing law and disputes
These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Abu Dhabi, and the courts of Abu Dhabi have jurisdiction. This does not affect any mandatory right you have to bring proceedings in your country of residence. Before going to court, please contact us at support@tibrcode.com so we can try to resolve the issue.
13. App store terms
Apple App Store. If you downloaded the app from the App Store:
- these Terms are between you and Tibrcode only, not Apple;
- Apple has no obligation to provide maintenance or support for the app;
- if the app fails to conform to an applicable warranty, you may notify Apple, which may refund the purchase price (if any); Apple has no other warranty obligation for the app;
- Apple is not responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, consumer protection claims, and intellectual property claims;
- you confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties;
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Google Play. If you downloaded the app from Google Play, the Google Play Terms of Service also apply.
14. Changes to these Terms
We may update these Terms. We will change the version and date at the top and tell you in the app before material changes take effect. If you keep using the Service after that, you accept the updated Terms.
